Refund and Returns Policy

Please read these Terms and Conditions (“Terms”) carefully before using the Luxe Living website (“the Service”) or placing an order. These Terms constitute a legally binding agreement between you and Luxe Living.

1. Acceptance of Terms

By accessing or using the Service or placing an order through the Service, you agree to be bound by these Terms and all applicable laws and regulations. If you disagree with any part of the terms, then you may not access the Service or place an order.

2. Definitions

  • “Luxe Living,” “We,” “Us,” “Our”: Refers to Luxe Living, an Ontario-based furniture retailer.

  • “Customer,” “You,” “Your”: Refers to the user of the Service or the purchaser of Products.

  • “Service”: Refers to the Luxe Living website, online store, and any related services provided by Us.

  • “Product(s)”: Refers to the luxury furniture, decor, and related goods offered for sale by Luxe Living.

3. Product Information and Availability

3.1. Accuracy: We strive to ensure all information, including Product descriptions, images, and pricing, is accurate. However, due to the nature of luxury and handcrafted items, actual finishes, colours, and dimensions may vary slightly from online representations. The settings on your monitor may also affect colour depiction.

3.2. Availability: All orders are subject to Product availability. If an ordered Product is unavailable, We reserve the right to cancel your order and provide a full refund, or offer an alternative Product.

3.3. Custom Orders: Products designated as “Custom” or “Made-to-Order” are uniquely manufactured according to your specifications. Production lead times are estimates and may vary.

4. Pricing, Payments, and Taxes

4.1. Currency: All prices displayed on the Service are in Canadian Dollars (CAD).

4.2. Taxes: Prices do not include applicable provincial (e.g., HST in Ontario) or federal sales taxes, which will be added to the total cost of your order during the checkout process, as required by Canadian law.

4.3. Payment: We accept various payment methods as indicated on the Service. You warrant that you are the lawful holder of the credit card or payment method used for the transaction. Products will not be ordered or shipped until full payment is received and verified.

5. Orders and Order Acceptance

5.1. Order Confirmation: Once an order is placed, you will receive an email acknowledging receipt. This confirmation does not signify our acceptance of your order; it confirms that We have received it.

5.2. Acceptance: Order acceptance is complete when We send you an email confirming the Product has been shipped or, in the case of Custom Orders, that manufacturing has officially begun. We reserve the right to refuse or cancel any order for any reason, including limitations on quantities available for purchase, inaccuracies in Product or pricing information, or issues identified by our credit and fraud avoidance department.

5.3. Cancellations (Standard Orders): You may request to cancel a standard, non-custom order within 24 hours of placement. After 24 hours, cancellation is at Our sole discretion and may incur a restocking fee.

5.4. Cancellations (Custom Orders): Custom orders cannot be cancelled or modified once manufacturing has begun (as confirmed by the acceptance email).

6. Shipping, Delivery, and Risk of Loss

6.1. Delivery Area: We primarily deliver within Ontario and Canada, but shipping terms for areas outside of Ontario may vary and require a custom quote.

6.2. Delivery Estimates: Delivery dates provided are estimates only. We are not liable for any delays in delivery due to carrier issues, manufacturing delays, or unforeseen circumstances.

6.3. Inspection and Acceptance: Upon delivery of the Product, you or your representative must inspect the item carefully before signing the delivery receipt. Note any damage, defects, or discrepancies directly on the delivery receipt. Failure to note damage at the time of delivery may result in the refusal of a damage claim.

6.4. Risk of Loss: The risk of loss for Products passes to you upon delivery to your specified shipping address.

7. Returns, Refunds, and Exchanges

7.1. General Policy: Due to the high-value and specialized nature of our Products, all sales are considered final unless the Product is defective, damaged upon delivery (and noted on the receipt), or incorrectly shipped.

7.2. Defective/Damaged Claims: Claims for defective or damaged Products must be initiated within three (3) calendar days of delivery. Photographic evidence and the original delivery receipt notation are mandatory for all damage claims.

7.3. Restocking Fee: Approved returns of standard, non-defective Products are subject to a minimum 25% restocking fee, plus return shipping costs. Products must be returned in their original packaging, unused, and in resalable condition.

7.4. Custom Order Policy: Custom, made-to-order, or personalized Products are strictly non-returnable and non-refundable, except in the event of manufacturing defects.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY ONTARIO AND CANADIAN LAW, LUXE LIVING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF (i) YOUR USE OR INABILITY TO USE THE SERVICE OR THE PRODUCTS; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS; OR (iii) THE PERFORMANCE OF THE PRODUCTS. IN NO EVENT SHALL LUXE LIVING’S TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT(S) IN QUESTION.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Province of Ontario and the applicable laws of Canada, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in the Province of Ontario to resolve any dispute arising from these Terms or your use of the Service.

10. Intellectual Property

All content on the Service, including text, graphics, logos, images, as well as the Products themselves, are the property of Luxe Living and protected by Canadian and international copyright and intellectual property laws.

11. Changes to Terms

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. The date of the last update will be listed at the top of this document. It is your responsibility to check these Terms periodically for changes.
